According to Justice Minister Cemil Cicek, Turkey is not in a position to take any further step without amending the Constitution. Because he says, the current Constitution did not comply the EU Acquisition. He also points out to the stress made on the “Constitution”, at the resolution of the Council of Europe which excluded Turkey from the list of countries under monitoring for democratic and human rights practices. The Constitutional amendment package which is being prepared by the government is set to cause considerable controversy in Turkey. The new Constitution motion emphasizes equality between men and women. Abolishes articles 15,17,38 and 87 to scrap capital sentence totally, emphasizes Turkey’s preference on EU against the United States of America by inserting the expression, “Unless in situations where the International Penal Court required, ” in front of the sentence: “The citizen will not be extradited to a foreign country because of crime.” The backbone of the package is the amendment on Article 90 which reads: “The international agreement will reign in case it conflicts the Constitution” and “There can be no petition made to the Constitutional Court on grounds that the international agreement violated the Constitution.” This provision foreseen by the government confirms that Turkey is sharing her sovereignty The amendment package which qas prepared by the R&D unit of AKP foresees to curb the powers of the President in naming the members of the High Court and the Republic’s Prosecutor. It abolishes the High Military Administrative Court and Military Appeals Court.
