ANKARA - A new draft law on legal notices, prepared by the Justice Ministry, has been sent to the Prime Ministry for consideration. The draft will first be discussed in cabinet and sent to Parliament afterward. Some of the contents of the draft are as follows:

E-mails: Legal notices by e-mail will be a first for Turkey. Individuals may choose to receive legal notices by e-mail, while the application will be mandatory for corporations. Legal notices by e-mail will be considered delivered three days after it reaches the recipient’s inbox.

Address-based population registration system: Legal notices will be based on the new system. In the event address changes have not been recorded in the system, or if notices cannot be delivered for another reason, the address in the system will be considered as the last known address and the legal notice will be sent there.

Neighbors cannot accept delivery: Legal notices will be sent to the address available in the system. In the event the recipient does not reside at the address, or has permanently moved, the courier will deliver the notice to the nearest local authority and place a notification on the door of the building cited as the address. This will be regarded as the delivery date without notifying neighbors or the apartment superintendent.

Legal notices for those residing abroad: The law in its present form means the Justice Ministry sends legal notices to those residing abroad. If the draft passes into law, courts will be able to be in direct communication with Turkish representative offices abroad and notices will be considered delivered 30 days after arrival at the representative office.
