The Commission yesterday sent out an information note to the attention of the border guards of the Member States, clarifying the requirements for travel documents of holders of residence permits or long-stay visas:
Namely that the travel document shall have been issued within the previous ten years, the Commission draws attention to the fact that, if this requirement is not fulfilled, according to Article 5(4)(a) of the Schengen Borders Code a third country national who holds a residence permit or a long-stay visa shall be authorised to enter the territory of the other Member States for transit purposes so that they may reach the territory of the Member State which issued the residence permit or the long-stay visa, unless their names are on the national list of alerts for of the Member States whose external borders they are seeking to cross and the alert is accompanied by instructions to refuse entry or transit.
The European Commission hopes that these clarifications will prevent those individuals entitled to cross the borders and fulfilling the conditions set out from encountering any further problems.
